All transactions, with the exception of credit card transactions, initiated through our service are facilitated through the Nami Wallet and you agree to abide by their Terms of Service and Privacy Policies.

CNFT GENIE is a marketplace and minting platform. CNFT GENIE is not a broker, financial institution, or creditor. The services offered are administrative only. CNFT GENIE facilitates transactions between buyers and sellers in traditional sales as well as auctions but we are not party to any agreements between buyers and sellers.

By using CNFT GENIE, you agree to binding arbitration in the event of a dispute. Furthermore, you agree not to be a party to any class action suits.

CNFT GENIE strictly prohibits all illicit photos, images, video, or art from being posted to the website. This includes all forms of nudity. Any violation of this rule, will result in a complete ban on using the site.

You agree not to violate any law, contract, intellectual property, or third party right. You agree to abide by all the terms and agree not to:

-Provide false or inaccurate information to CNFT GENIE.

-Use someone else’s account.

-Create or list counterfeit items.

-Use the software or API in any way that the service could be impaired.

-Access any part of the service that you do not have authorization to access.

-Use information from the service to contact any individuals, companies, or other persons or entities.

-Use the service to launder money or engage in any illegal or unauthorized purpose that violates the Terms of Service, including, but not limited to, any terrorist activities or any other illegal type of funding.

-Place misleading or insincere bids or offers.

-Purposing a listing to appear at the top of the search results.

-Any activities that will artificially increase viewing counts.

-Any financial activities subject to registration or licensing to create listings, or buying securities, commodities, options, real estate, or debt instruments.

-Use service from a country sanctioned by the government of The United States.

-All assets, listings, and collections that CNFT GENIE deems inappropriate or illegal are strictly prohibited. We reserve the right to determine the appropriatness of listings on the site and we can remove them at any time.

Listings that include metadata that is in violation of international or U.S. intellectual property laws, incite hate, depicts sexually, materials or anything racist or otherwise offensive behavior is strictly prohibited on CNFT GENIE.

List assets for the purpose of raising or moving funds for known terrorist organization and are strictly prohibited from using CNFT GENIE.

-List any illegally obtained assets. This will result in removal of your account.

-Any persons under the age of 18; However, they may use the account of a parent or guardian with permission.

-Any NSFW content is not allowed on the platform.

Create or list any illegal or otherwise offensive content that depicts any sexual acts or images that include children under the age of 18. Profanity and graphic language in any listed content on CNFT GENIE.

You represent that you have all rights, licenses, consents, permissions, authority necessary to grant the rights granted herein for any user information that you submit, post, or display on or through the services. You agree that user information will not contain material subject to copyright or other proprietary rights, unless you are legally entitled to post the material and to grant CNFT GENIE the license described above.

We reserve the right to remove content without prior notice in response to formal infringement claims or any other posting deemed to be in violation of the Terms of Service.

You agree to indemnify, defend, and hold harmless CNFT GENIE from and against all actual or alleged third party claims, damages, awards, judgements, losses, liabilities, obligations, penalties, interest fees, expenses (including attorney fees and expenses) and all costs of all kinds and nature whatsoever, including, but not limited to, damages to property or personal injury that are caused by your use or misuse of the service and/or user information or violation of the terms of this agreement.

CNFT GENIE does not represent or warrant that content on the service is accurate, complete, and reliable. We will not be liable for any loss of any kind from using the website. While we make your access and use of the service and content safe, CNFT GENIE cannot and does not represent or warrant that the service is free of all viruses or otherwise harmful components. We cannot guarantee the security of your data. You agree to accept the inherent security risks of doing business online and you will not hold us responsible for any breach of security unless it is due to our gross negligence. We will not be liable to you for any loss that is incurred from the use of the site.

We will not be responsible for claims from the following:

A. User error, forgotten passwords, incorrectly constructed transitions, or mistyped addresses.

B. Server failure or data loss.

C. Corrupted wallet files.

D. Unauthorized access to applications.

E. Any unauthorized third-party activities, including without limitation, the use of viruses, phishing, or other means of attack against the website.

CNFT GENIE is not responsible for any kind of attack, unusual software behavior, smart contracts failure, blockchain failures or any other situation resulting in the loss of funds.

Not all jurisdictions allow implied warranty exclusions in consumer contracts, so if one of these jurisdictions, the above exclusion, may not apply.

A. Crypto assets fluctuate, we cannot guarantee that you will not lose money.

B. You are responsible for determining what, if any, taxes apply to your transactions. We are not responsible for determining this for you.

C. We do not send, receive, or store NFTs. They exist on the blockchain and the only ownership record maintained on the supporting blockchain. All transfers occur within the supporting blockchain and not on this service.

D. There are inherent risks when using an internet-based currency, including the risk of failures in hardware, software, and internet connections, hardware risks, introduction to malicious software, and the risk that third parties may obtain unauthorized access to information stored within your wallet. CNFT GENIE is not responsible for any communication failures or errors you may experience.

F. Our service will rely on the use of the Nami Wallet and smart contracts. We are now responsible for any losses that come from the use of this wallet.

A. Crypto assets fluctuate, we cannot guarantee that you will not lose money.

G. There is a risk of purchasing counterfeit assets that are vulnerable to metadata decay, assets on smart contracts with bugs, and assets that may become untransferable. Under no circumstance shall the inability to view your assets on CNFT GENIE serve as grounds for a claim against CNFT GENIE.

Under no circumstance shall CNFT GENIE be liable to you or any third parties for any lost profit or any damages arising from these Terms of Service, products or any third-party sites and products, or for any damages related to revenue loss, profits loss, business or anticipated savings loss, loss of use, or loss of data, whether or not caused by negligence. Use of CNFT GENIE is at your own discretion and risks, and you will be solely responsible for any damage to your computer system or mobile device or loss of data resulting.

We reserve the right to change, suspend, or discontinue, temporarily or permanently the services. We may suspend or discontinue the auction at any time and without any liability.

These terms shall be governed and enforced in the State of Texas, any arbitrations shall occur in Travis County.

CNFT GENIE reserves the right, without notice and in our sole discretion, to terminate your right to access or use the service at any time and for any reason. You agree that we shall have no liability in such event and no refunds shall be given.

If any of this agreement is found to be unenforceable, it will not affect the validity or enforceability of the remaining part of that term, clause, provision, or any other term, clauses or provision of these Terms and Conditions.

CNFT GENIE’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
